ORDINANCE NO. 31-21: Fee Waiver for Accessory Dwelling Unit (ADU) Projects on Lots Containing Single-Family Homes

Ordinance No. 31-21 waives Plan Review, Building Inspection (excluding Electrical and Plumbing), Records Retention and Site Surcharge Fees for Accessory Dwelling Units on lots containing single-family homes.

The Ordinance is retroactive to January 1, 2021 and expires June 30, 2023. Eligible Accessory Dwelling Unit projects that applied for building permits after January 1, 2021 will receive a refund of applicable fees paid.

For eligible Accessory Dwelling Unit projects that applied for building permits on or before January 1, 2021 and had not received a final certificate of occupancy by the January 1, 2021 retroactive date, the fee waiver applies only to applicable fees that had not been paid as of January 1, 2021.  Fees paid before January 1, 2021 are not eligible for refunds. 

The Ordinance defines Accessory Dwelling unit as that set forth in Planning Code Section 102. The fee waiver applies solely for the establishment or modification of the accessory dwelling unit and no other work on the property that is subject to the building code.
