A. CALL TO ORDER and ROLL CALL.
The meeting of the Abatement Appeals Board for Wednesday, February 16, 2022 was called to order at 9:12 a.m. and roll was taken by Comll).ission Secretary Sonya Harris, and a quorum was certified.

Ramaytush Ohlone Land Acknowledgment.
The Abatement Appeal Board acknowledges that we are on the unceded ancestral homeland of the Ramaytush Ohlone, who are the original inhabitants of the San Francisco Peninsula. As the indigenous stewards of this land and in accordance with their traditions, the Ramaytush Ohlone have never •ceded, lost, nor forgotten their responsibilities as the caretakers of this place, as well as for all peoples who reside in their traditional territory. As guests, we recognize that we benefit from living and working on their traditional homeland. We wish to pay our respects by acknowledging the Ancestors, Elders, and Relatives of the Ramaytush Ohlone community and by affirming their sovereign rights as First Peoples.
B. FINDINGS TO ALLOW TELECONFERENCED MEETINGS UNDER CALIFORNIA
GOVERNMENT CODE SECTION 54953(e). (Discussion and Possible Action)
The Board will discuss and possibly renew findings that it adopted at its October 20, 2021 meeting that are necessary to authorize the Board to hold meetings remotely under the modified Brown Act provisions in Assembly Bill 361.
Secretary Harris asked if all Commissioners were in agreement to continue to meet remotely.
All members said aye.
The motion carried unanimously.
C. ELECTION OF OFFICERS: (Action) The Board will accept nominations for the positions of President and Vice President and vote to elect members to those positions.
Secretary Harris called for public comment, and there was none.
President Alexander-Tut stated that she would begin the round of going to each Commissioner for their nominations, and she began with Vice-President Tam.
Vice President Tam nominated Commissioner Sommer for Abatement Appeals Board (AAB)
President, and Commissioner Eppler for Vice-President.
Commissioner Bito nominated Commissioner Tam for President and Commissioner Sommer for Vice President.
Commissioner Eppler did not add any nominations.
Commissioner McCarthy nominated Commissioner Tam for President and Commissioner Eppler for Vice-President.
Commissioner Sommer did not add any nominations.
President Alexander-Tut did not add any nominations.
Secretary Harris stated that there were three nominations, and the first one was for Commissioner Sommer as President and Commissioner Eppler as Vice-President. Ms. Harris asked Deputy City
Attorney Porianda for clarification regarding the process.
Deputy City Attorney Porianda stated that under the rules the round of nominations happens and then they are closed. Next, members vote on the order in which the nominations were received for each office. For example, for President the first nomination was for Commissioner Sommer so the Board would do a round of voting on that motion and once the majority was received then you go to the next nominee.
Secretary Harris said that the Board would first vote on the office of President and then VicePresident.
Deputy City Attorney Porianda clarified that no second was required on the motions.

There was a motion to nominate Commissioner Sommer as the Abatement Appeals Board President.
Secretary Harris Called for a Roll Call Vote:
President Alexander-Tut Yes
Vice President Tam Yes
Commissioner Bito No
Commissioner Eppler Yes
Commissioner McCarthy No
Commissioner Sommer No
Commissioner Moss Excused
The vote was 3 to 3, and the motion did not carry, because Commissioner Sommer declined the nomination.
There was a motion to nominate Commissioner Tam as the Abatement Appeals Board President.
Secretary Harris Called for a Roll Call Vote:

Commissioner Eppler Yes
Commissioner McCarthy Yes
Commissioner Sommer Yes

The motion carried with a vote of 5 to 1, with Commissioner Alexander-Tut dissenting.
The Board congratulated President Tam.

There was a motion to nominate Commissioner Eppler as Vice President of the Abatement Appeals Board.

The motion carried unanimously.
The Board congratulated Vice-President Eppler.
D. APPROVAL OF MINUTES: (Discussion and Possible Action)
Discussion and possible action to adopt the minutes for a meeting held on: January 19, 2022.
President Tam made a motion, seconded by Commissioner Bito, to adopt the meeting minutes of January 19, 2022.
The motion carried unanimously.
There was no public comment.
E. GENERAL PUBLIC COMMENT
There was no general public comment.
F. ADJOURNMENT
President Tam made a motion to adjourn the meeting, which was seconded by Commissioner Bito. The motion carried unanimously.
The meeting was adjourned at 9:25 a.m.
