NOTICE OF DECISION

BOARD OF EXAMINERS MEETING

February 12, 2001

CASE NO. 2001-01

On February 12, 2001, the Board of Examiners held a duly noticed public hearing to determine whether the proposed addition at the existing attic space at 2640 Broadway (a single family dwelling) will be allowed to comply with footnote #13, Table 5B of the 1995 San Francisco Building Code which requires that only the garage level and the floors below to be fitted with sprinklers in lieu of the current 1998 San Francisco Building Code which requires that the entire building be fitted with sprinklers. The appellant states that the proposed 250 sq. ft. expansion at the attic space does not change the building envelope or height of the existing building. This proposal will only increase the overall area of the building by 3% and compliance to the current 1998 San Francisco Building Code would trigger the requirement to fully sprinkler the entire building. Compliance to this current requirement would necessitate costly modification to the building.

Testimony was given by the appellant=s representatives from Jaidin Consulting Group and from City Staff present. Based on the presentation of oral and written testimony, the Board of Examiners voted 5-0 to approve the appellant=s request. The approval of the proposed expansion at the existing attic area is subject to the following conditions.

1. Sprinkler the entire garage level and floor below with quick response head sprinkler system. The sprinkler system shall be designed by a Licensed Professional Engineer, that is either a Mechanical Engineer, or Civil Engineer, or a Fire Protection Engineer, or a Licensed C16 Contractor, who is specifically engaged in sprinkler work.

2. Hard-wired smoke detectors shall be installed throughout the building on all levels including the attic.

3. A fire alarm system which will connect all smoke detectors and sprinkler alarm valve will be connected to an alarm panel which will send a signal to an outside monitoring agency, and the agency will then notify the San Francisco Fire Department.

4. All the above provisions shall be presented on proper plans to the Department of Building Inspection for proper approval and issuance of a building permit.

5. This sprinkler system variance is a one time only approval.
