Development Impact Fee - Collection Process & Procedure

NOTICE - EFFECTIVE JULY 1, 2013

On July 1, 2013, the option to defer development fees created in Section 107A.13.3 of the San Francisco Building Code will expire. Projects remain eligible for the Fee Deferral Program (Program) if they are either already in the Program, or if prior to July 1, 2013 a complete application package has been submitted for a building or site permit AND a signed Fee Deferral Request Form is on file with Department of Building Inspection. Beginning 7/1/2013, all development impact and in-lieu fees will be due in full prior to issuance of the first construction document if a fee deferral request form is not on file by that date.

Pursuant to Planning Code Section 403(b), the San Francisco Planning Commission intends to hold a hearing on June 13, 2013 to review the effectiveness of the Program, the economy at large, and whether the stimulative effects of the Program are still necessary. To comment, please attend the meeting or send feedback to the Planning Commission c/o AnMarie Rodgers at 1650 Mission St, Suite #400, San Francisco, CA 94103. Meeting information will be posted at http://sfplanning.org/index.aspx?page=3359. The Commission will consider forwarding a recommendation to the Board of Supervisors (BOS) as to whether the Program should be continued, modified or terminated. The BOS will make the final decision, and no action is expected before July 1, 2013.

Citywide Development Fee Register - Effective April 29, 2013

Effective January 1, 2013, most Development Impact Fees will increase by 4.00% in accordance with San Francisco Planning Code Article 4, Section 409(b). The new fee schedule applies to Development Impact Fees collected on or after January 1, 2013 (including applications that were filed before January 1st for which fees have not been paid by January 1st). The Controller’s Office annually adjusts the applicable fees based on the Annual Infrastructure Construction Cost Inflation Estimate (AICCIE) published by Office of the City Administrator's Capital Planning Group and approved by the Capital Planning Committee. These rate adjustments will occur annually on January 1st, with a few exceptions noted on the impact fee register. Effective January 17, 2013, the Transit Development Impact Fee will change pursuant to Ordinance 247-12.
